The Basic Conditions of Employment Act (BCEA) is a South African law that sets out the minimum standards for employment conditions in the country. The Act applies to all employers and employees, except for members of the National Defence Force, National Intelligence Agency and South African Secret Service.
The BCEA covers a wide range of issues related to employment conditions, including:
Working hours: The Act specifies the maximum number of hours an employee can work per week, as well as the amount of overtime pay they are entitled to if they work beyond their regular hours.
Leave: The Act sets out the minimum amount of annual leave, sick leave, family responsibility leave and maternity leave that an employee is entitled to.
Pay and remuneration: The Act requires employers to pay employees at least the minimum wage, as well as any overtime pay or other allowances they are entitled to.
Termination of employment: The Act sets out the procedures that employers must follow when dismissing an employee, as well as the minimum notice period they must provide.
Health and safety: The Act requires employers to provide a safe and healthy working environment for their employees, and to take steps to prevent workplace injuries and illnesses.
